Bullish on Patents

Don’t count out patents. Congress has considered as multiple new patent reform bills, but authorities and commentators are warning to not throw out the baby with the bath water. Tangible IP CEO Louis Carbonneau asks “Are Patents Getting Their Mojo Back?” and cites the forces pushing back on the concerns that the pendulum may have swung too far in the fight against trolls. Patent litigation is up, after a dip last year, and the majority of cases are brought by operating companies, not NPEs. The courts are trying to rein in the PTAB’s perceived hostility to patents, and the USPTO is trying to show “pathways to eligibility” where an abstract idea is only tangential to the claims.

A healthy patent ecosystem is important to an innovative economy. Institutional changes will not take away the constitutional rights in patent enforcement. An insurance policy through IPISC can help you hold your own in these turbulent times.
